Bend dentist asks court to review $348,000 penalty for Scientology training
A Bend dentist has asked the Oregon Court of Appeals to review a $348,000 penaltystemming from allegations that he required employees to attend a Scientology-related training session.
The Bureau of Labor and Industries imposed the fine in September to settle charges of religious discrimination at Dr. Andrew W. Engel's practice, Awe Dental Spa.
Michael Gordon, a Portland attorney representing Engel, filed a petition last week with the appeals court. He has not responded to The Oregonian's request to comment.
The order is tied to an October 2009 symposium that BOLI alleges was required. Employees had received a conference outline the preceding August referencing a Scientology concept known as the "tone scale."
Soon after, Susan Muhleman, who worked as a dental assistant, told Engel that it would conflict with her Christian beliefs. BOLI contends that Engel told her the conference was mandatory and turned down her request for secular training instead.
Muhleman quit weeks before the three-day conference, then moved out of the state to pursue a new job. At the time, Bend's jobless rate topped 12 percent.
Engel was ordered to cover Muhleman's lost wages and moving expenses, as well as pay damages for emotional distress.
The appeals court doesn't announce in advance when it will issue a decision, but cases commonly take a year or more to decide.

Of course, the 33-year-old has become a regular on the subway following her split from Cruise and regularly catches public transport to work on her new Broadway show.
She is currently starring in the production Dead Accounts and recently said she can't imagine ever getting bored of performing on stage in front of an audience.

She told Vogue: 'It's exciting because there's no close-up, so a person has to use every inch of themselves. So you're never done -- and who wants to be done? It's just another opportunity to keep growing.'
The actress, who appeared in the Broadway show All My Sons in 2008, stars in the new show alongside Norbert Leo Butz, Judy Greer and Josh Hamilton and previously admitted she feels the pressure to win rave reviews.
She said: 'I have a hard time sleeping because I think about how serious this all is,' she admitted. 'I think about the cost of tickets. I think to myself: 'You better do a good job. People are paying a lot of money.' You want to know your stuff.'

The brunette beauty also opened up about their life at home and admitted she is a terrible cook.
She said: 'Me in the kitchen is a comedy. But it's heart breaking for me going through it.
'But for others, they probably think it's funny because all the pans are out and I get frustrated, and suddenly it's burning. And I went to Eataly (Mario Batali's New York market) I got the stuff. And it still turned out, like... not good.'
